Members present:

Notice of Intent, Mass Highway 270 Main St., Map 17 Parcel 57.  Capping of an inactive solid waste disposal area. Continued from August 7, August 21, 2008, September 4, 2008, September 18, 2008. (Originally on the April 17, 2008 agenda.) Continued from October 2, 2008.  The Conservation Commission received a letter of January 14, 2009 from Michael Furlong, Environmental Analyst with the Massachusetts Highway Department, asking that the NOI, file number 198-0236 submitted on June 16, 2008, be withdrawn without prejudice.  VA made a motion to accept the withdrawal without prejudice and JS seconded the motion.  The Commission voted to agree 7-0.

Minutes:  TF made a motion to accept the minutes of January 15, 2009 with one edit.  VA seconded the motion and the Commission voted 6-0-1 with DF casting the abstaining vote as he was not present at that meeting.

Laurel Lake Preservation Association, Inc., NOI, Laurel Lake.  Conflicts in scheduling have resulted in a request by the applicants to continue the February 19, 2009 continued hearing to March 2, 2009.  The hearing will be at the Lee Conservation Commission at 7:00 pm.  PA will relay the information to the applicants and to the Lee Conservation Commission.  

Other business:
Dock on Housatonic River: NC advised the Commission that he met with Town Manager Greg Federspiel, DPW Superintendent Jeff Vincent, Samantha Lefenfeld and Dennis Regan of H.V.A., and Jeffrey Nield of ESS Group Inc. to discuss the need for a dock at the pedestrian bridge.  No action at this time.
Hardy Kiwi: JS advised the Commission that he is becoming concerned about the hardy     kiwi vines that are taking hold in many areas of Kennedy Park and Pleasant Valley. Thomas J. Rawinski, a botanist has told JS that he thought the Forest Service has grants that communities can use to attack the problem.  JS asked the Commissioners for direction.  Discussion ensued and it was decided that JS will contact the Town Planner, Mary Albertson.     

RDA, Berkshire Montessori School, Inc. Patterson Road, Map 2 Parcel 27.  Construction of a school and related site work.  Presenting the RDA was Rob Hoogs of Foresight Land Services and Todd Covert, the head of the Montessori School.  Mr. Hoogs described the 26 acre wooded site and presented a site plan.  Only 4.5 acres will be disturbed and Mr. Hoogs said that area is well outside any wetland buffer zones and beyond the jurisdiction of the Conservation Commission.  

A site visit was scheduled for Saturday, February 7, 2009 at 9:00 am.  RFC made a motion to continue the meeting to February 19, 2009 at 7:30 pm. DF seconded the motion and the Commission voted 7-0 to agree.
